Terms & Conditions
​In the following terms and conditions “the Photographer” shall mean Jodie Hope trading as ‘Jodie Hope Photography’. “The Client” shall be those persons responsible for booking the photography services.
It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of these terms shall be effective unless agreed by both parties in writing.
Forms
Booking forms need to be filled out no later than 72hrs after being sent. Failure to do so will result in the shoot or wedding photography being cancelled.
Copywrite
The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
Use of images
The client hereby allows the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc. Please tag JodieHopePhotography in posts of photos where possible, this helps my business a lot.
Creative license, coverage and reproduction
Every effort is made to comply with the client's wishes, although all photos will be at the discretion of the photographer. This contract allows the client to use the photos for personal and non commercial use.
Payments
A non refundable booking fee is taken to book a photoshoot. All deposits are non refundable, however if the shoot is cancelled above 48hrs prior to the shoot then the deposit will be transferred to a future date. Any shoot cancelled under 48hrs prior to the shoot will lose the deposit. The deposit will be deducted from the cost of the client's chosen package.
Portrait photography sessions, gift vouchers and fixed cost discount packages are payable on the day of the shoot (after the deposit). In the event of the client not fulfilling the payment due, the photographer will not deliver any photos until the outstanding balance is paid. Should the client later order any additional printed products or digital files these will be payable at the time of order.
If you run over your session time an extra charge may occur.
Cancellation of photographer
In the very unlikely events of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid. The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding, traffic conditions, vehicle breakdown etc.
Personal Accident
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
Delivery
The photographer will endeavour to deliver digital as quickly as possible. I can understand the excited to see the results but please try not to continually ask when the finished product will be done. For shoots allow up to 10 days for digital images. For additional products (prints, photo book, illustrations etc) please allow up to 4 weeks. Photo galleries expire after 1 year. The photographer will keep photos on file for 2 years from the date of shoot.
Liability
The Photographer will maintain Public Liability and Professional Indemnity insurance at all times. However, in the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for any indirect or consequential loss. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
Travel
Although I am island based I am happy to travel. No travel expenses are charged for shoots on the Isle of Wight. Travel expenses will be discussed between the client and photographer for mainland shoots, this can include accomodation. If the portrait session is taking place on location, any entrance fees or related expenses will be payable by the Client.
Editing
Photos are edited by the photographer in their style or in an agreed style before the shoot. Unless expressly agreed in writing the Client shall not be entitled to reject images on the basis of style or composition. The Client cannot re edit or crop out the watermark after the photos have been edited by the photographer.
Confidenciality
The Photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to her in confidence for the purposes of the photography except where reasonably necessary to enable the Photographer to carry out her obligations in relation to the commission. Any information or data is kept in accordance with data protection principles set out in the Data Protection Act available on the ICO (Information Commissioner’s) website.
